Our privacy policy

Genesis provides the agricultural sector with services related to the measurement and assessment of soil quality, including the development of scores (for comparison) and the operation of a service to improve knowledge of the impact of agricultural practices on soil health. As part of its activities, the company Genesis, (hereinafter referred to as” Genesis ”) is required to collect and process certain personal data.

Genesis acts as data controller. Genesis respects the right to privacy and recognizes the importance of protecting personal data.

In this respect, Genesis, acting as data controller, processes your personal data in accordance with the provisions of Regulation 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as the “” RGPD ”), of Law No. 78-17 of January 6, 1978 relating to information technology, files and freedoms and other applicable laws, as well as to the provisions of this privacy policy (hereinafter referred to as the” Confidentiality Policy ”).

The purpose of the Privacy Policy is to detail the origin and use of personal data collected and processed by Genesis as well as the measures it implements in order to best protect such personal data.

Section 1. DEFINITIONS

In this Privacy Policy, terms beginning with a capital letter will have the meaning assigned to them below:

Section 2. CATEGORIES OF PERSONAL DATA COLLECTED

The Personal Data that Genesis is required to process as part of its activities are:

  • your name,
  • your email address,
  • your mailing address,
  • your correspondence and contact data (telephone number and other identification data),
  • your Genesis Platform usage data (the data and information regarding the provision, use, and performance of the services and the Genesis Platform, as well as your access to and use of the Genesis Platform, including, without limitation, navigational, transactional, processing, processing, computer data (such as IP address and browser) data (such as IP address and browser), statistical and other analytical data, statistical usage data derived from the operation of the services and configurations, the data of journal and the results of the performances of the Genesis Platform).
  • your username and password created on the Genesis Platform,
  • your professional activities (characteristics of the professional activity carried out),
  • your ownership status and the characteristics of your property (for example, its location, size),
  • and the results of the soil samples associated with your property (the raw data),
  • and when linked to an identifiable natural person, the Score (see Article 3).

Genesis calculates the Score based on a combination of data, which includes the results of the soil sample collected for your property and data from third parties. The Score associated with your property will be aggregated with ratings for other properties and will be anonymized in a number of circumstances. When the note and its use are not anonymous and are linked to an identifiable natural person, the terms of this Privacy Policy apply. The terms of the privacy policy do not apply to the data of legal entities.

Personal Data is collected by Genesis directly from you, from its Customers, or is created by Genesis through the analysis and scoring of soil samples.

This list is subject to change depending on the information provided to you by Genesis.

Section 3. PURPOSES OF THE PROCESSING OF PERSONAL DATA

The processing of Personal Data carried out by Genesis is necessary to enable it to achieve the following purposes:

  • generate a Score associated with a sample of agricultural soil, by combining the Score of your property and other non-personal data, in the manner described in article 2;
  • as part of Genesis' contractual relationships with its Customers, make certain Personal Data available to Customers, in particular via the Genesis website (this data may include the Score, the identity of your company and your address);
  • make certain data, including raw data and Score, available to you;
  • develop the functionalities of the Genesis website and the methodologies for scoring your property;
  • carry out marketing operations (for example, by post or electronic means);
  • communicate with you;
  • protect your legal interests as well as those of Genesis and its Customers, perform contractual obligations and exercise rights resulting from contracts signed by Genesis, and comply with legal obligations;
  • manage requests to exercise the rights listed in article 7 below;
  • any other use that allows the improvement of the services provided by Genesis, as described to you.

Section 4. LEGAL BASES FOR THE TREATMENTS IMPLEMENTED

In accordance with applicable legislation on the protection of personal data, the processing of Personal Data implemented by Genesis is based on one of the legal bases referred to below.

Your consent

When your consent is required in connection with the processing of Personal Data, you will be explicitly asked for it. You can withdraw your consent at any time.

Genesis' legitimate interests

The processing of your Personal Data is necessary for the purposes of the legitimate interests pursued by Genesis, and does not affect your interests and fundamental rights. In particular, and without limitation, Genesis pursues legitimate commercial interests, carries out marketing operations, ensures the development of its services and asserts its legal rights and remedies. The transfer of Personal Data to our third party customers is carried out in accordance with our legitimate business interests, in order to meet business obligations.

Executing your contractual relationships with Genesis

Some processing of your Personal Data is necessary for the execution of contracts between you and Genesis, or for the execution of pre-contractual measures taken (for example, and without this being limitative, creating a user account on the Genesis Platform). For example, if you registered on the Genesis site in order to organize the collection of a soil sample and the transfer of the Score obtained to one of your and our Customers.

Compliance with Genesis' legal obligations

The processing of your Personal Data implemented by Genesis may be imposed by a legal obligation to which it is subject.

Section 5. DURATION OF STORAGE OF PERSONAL DATA

Your Personal Data collected and processed by Genesis will be retained for 5 years following the termination of the contract between you and Genesis, and/or between Genesis and its Customers, and as described in our terms and conditions of service and any other document made available to you.

Personal Data associated with your online account will be retained for as long as your account is active. Genesis reserves the right to delete online accounts if they have been inactive for a period of three years or more.

For the carrying out of electronic marketing operations, your Personal Data may be kept for 3 years following the last electronic contact on your part.

Some Personal Data may be stored and processed beyond the periods provided for (i) for reasons related to the exercise of legal rights; and/or (ii) for the purposes of research, identification and prosecution of criminal offenses for the sole purpose of allowing, as required, the provision of this data to judicial and regulatory authorities.

These deadlines apply subject to information to the contrary provided by Genesis and in accordance with applicable laws.

Section 6. PERSONAL DATA SHARED WITH THIRD PARTIES

Genesis may share certain Personal Data securely with third parties, when necessary to enable it to comply with the above purposes. The processing of your Personal Data by these third parties may be subject to the terms of the third party's privacy policy.

In this context, the categories of recipients likely to be provided with certain personal data are as follows:

  1. Customers;
  2. subcontractors engaged by Genesis to assist in the delivery of Genesis services;
  3. advice from Genesis;
  4. third parties, in the context of a corporate transaction (sale, acquisition, merger, etc.);
  5. financial, judicial or administrative authorities upon request and within the limits of what is authorized by applicable legislation.

When Genesis is required to communicate your Personal Data to third parties located outside the European Economic Area (EEA), Genesis undertakes to comply with the terms of the GDPR with respect to international transfers of personal data, in particular the provisions concerning the use of standard contractual clauses approved by the European Commission. Section 7. YOUR RIGHTS

You have a number of rights relating to your Personal Data which, subject to the application of applicable laws, are as follows:

  1. a right of access: it allows you to obtain information concerning the processing of your Personal Data as well as a copy of said data;
  2. a right to rectification: it allows you to request that Personal Data that you consider inaccurate or incomplete be modified accordingly;
  3. under certain conditions, a right to object: it allows you to oppose the processing of your Personal Data for reasons related to your particular situation;
  4. a right of limitation: under certain conditions, it allows you to suspend the processing of Personal Data to which you are subject while keeping the data processed;
  5. under certain conditions of a right to portability: it allows you to obtain the return of Personal Data that you have provided or, when technically possible, for them to be transferred to a third party. The information requested will be provided to you in electronic form, unless otherwise expressly requested;
  6. a right of deletion: it allows you to obtain the deletion of your Personal Data under certain conditions.
  7. the right to withdraw your consent: when the legal basis for the processing of Personal Data implemented is consent, it allows you to withdraw your consent at any time.
  8. the right to define guidelines for the storage, deletion and communication of your Personal Data after your death. In the absence of contrary instructions from the deceased, it is possible for the heirs to request that the data controllers take into account the death in order to delete or update the deceased's account.
